Protecting the name of your podcast with a trade mark

If you manage or present a podcast and have spent time building up its reputation, you want to be assured that it is protected against someone starting a podcast with the same name.

Oliver Spies, a European trade mark attorney specialising in the field of trade marks and design rights, spoke to Daniel Wagner at Podcast Stories about options for protecting a podcast.

Oliver and Daniel discuss common questions about trade marks and intellectual property from podcasters, including:

  • What can I protect in the context of names?
  • Can a podcast title be protected?
  • Can I implement the whole thing myself or do I always need an expert for the implementation?
  • To what extent can I have my podcast title protected?
  • What are the steps in this process, what happens and how long does it all take?
  • What costs should I expect?
  • What and how can I check certain things in advance?
  • What if another podcast comes out tomorrow with the same podcast title?
